(1) Introduction.

(1.1) Pieces of information made available to Anti-Corrosive Vanguard indicated clearly that the Honourable Justices of the Supreme Court of Nigeria shall officially entertain appeals from the Lower Courts immediately after the celebration of the New Legal Year for 2015/2016 fixed for the 21st day of September, 2015.

(1.2) The Honourable Justices of the Supreme Court of Nigeria shall commence The New Legal Year Celebration with the swearing in ceremony of the newly promoted 21 lawyers to the rank of Senior Advocates of Nigeria (SAN) at a special session according to the information made available from the Chief Registrar of the Supreme Court of Nigeria, Barrister Ahmed Gambo Saleh.

(1.3) It is on record that the Honourable Justices of the Apex Court of The Land embarked on an Annual Judicial Recess on the 13th day of July, 2015.

(1.4) The Annual Judicial Recess is a yearly vacation/holiday enjoy by the Nigerian Judges to carry out in-depth litigation research work, training on cases management, and the latest discovery in the global judicial pronouncements which may improve the administration of justice in Nigeria.

(2.0) Analyses Of Restoration Application Before The Supreme Court Of Nigeria.

(2.1) On 7th of February, 2011, King Professor CJA Uwemedimo, the Chairman and Chief Executive Officer of Comandclem Nigeria Limited, officially dismissed the General Manager of his company Pastor Monday Akpan in a letter written to that effect.

(2.2) Out of annoyance and wickedness, Pastor Monday Akpan (dismissed staff of CCNL) filed A Notice of Withdrawal on 24th of March, 2011 with the official signature of Professor Tony Ukam ESQ (former CCNL`s Lawyer)  to revenge his dismissal from the company.

(2.3) On 5th of May, 2014, Honourable Justice Walter Samuel Nkanu Onnoghen (JSC) dismissed CCNL`s Appeal because of the Notice Of Withdrawal allegedly written by Professor Tony Ukam ESQ (former CCNL`s Lawyer).

(2.4) On the 5th day of May, 2011, Honourable Justice Walter Samuel Nkanu Onnoghen (JSC) ruled as follow;

“There is nothing to be adjourned as the appeal withdrawn has ceased to exist. In the circumstance, appeal SC./69/2011 withdrawn is hereby dismissed.”

(2.5) On 11th of August, 2014, CCNL filed A Restoration Application/Motion to set aside the ruling delivered on 5th of May, 2014, and to restore the dismissed appeal against Mobil Producing Nigeria Unlimited.

(2.6) On 22nd of October, 2014, Mobil Producing Nigeria Unlimited resisted The Restoration Application/Motion filed by CCNL on the ground that Pastor Monday Akpan (dismissed staff of CCNL) was the staff of CCNL that filed the Controversial Notice of Withdrawal.

(2.7) Specifically, in paragraph 4 (xiv) of The Counter Affidavit filed by Mobil Oil in the Supreme Court of Nigeria, Eyimofe Atake (SAN), lawyer of Mobil Oil, confessed that Pastor Monday Akpan was the staff of CCNL that filed the Controversial Notice of Withdrawal but failed to serve them,  when Eyimofe Atake (SAN)  said and I quote him verbatim.

“That contrary to the facts deposed to in paragraph 5(ii) of the applicants` affidavit, on 24th March 2011 when the said Notice was filed, a Pastor Monday Akpan gave the Registry of this honourable court an undertaking that he would serve the notice on the respondents in their offices. There is now produced and shown to me, the Notice of Withdrawal marked “SI 1” showing at the bottom part of the Notice, the undertaking by Pastor Monday, Akpan”.

(2.8) The decision to restore the CCNL`s Appeal dismissed on 5th of May, 2014 shall be made by the Honourable Justices Of The Supreme Court Of Nigeria on the 19th day of October, 2015.

(2.9)Orphans, widows, market cleaners and poor Nigerians who have invested in the patented invention of King Professor CJA Uwemedimo for years would have been receiving their respective royalties/profits  before now if not because of the Notice of Withdrawal filed by Pastor Monday Akpan  (dismissed staff of CCNL) to dismiss the CCNL`s Appeal before the Supreme Court.

(2.10)When King Professor CJA Uwemedimo was alive, he had cursed Pastor Monday Akpan (dismissed staff of CCNL) for anti-company`s activities.

(3.0) The Anti-Comandclem Activities Of Professor Bankole Sodipo

(3.1) On the 2nd day of June, 2015 when the restoration application came before the Honourable Justices of the Supreme Court of Nigeria for determination, one Professor Bankole Sodipo disrupted the hearing by claiming to have been employed to lead the Appeal of CCNL by Queen Akon Uwemedim (wife of the king) and Reginould Uwemedimo (son of the king) contrary to the legacies of the King ( who duly contacted and briefed Babatunde Aiku (SAN), Rev. Barr Jesse Daniels Onuigbo and Barrister Kunle Faokunla.

(3.2) On the faithful day, 2nd of June, 2015, Honourable Justice Walter Samuel Nkanu Onnoghen (JSC) ruled as follows.

“I think the best thing to do in this circumstance is to give them the chance, let them come back with one counsel to represent them, then on that day, the court can look into those applications and move in terms.

By sitting down here, we are ready to deal with the matter; at least those applications that are in the case files, not those ones that are just coming in now.

If we don’t do that, they will say we have denied them fair hearing, and there is no other court to appeal except on the internet.

So, Dr. Eyimofe Atake (SAN), we take you down that you reluctantly concede for an adjournment.”

(3.3) The Board of Directors re-constituted by Late King Professor Emeritus CJA Uwemedimo and duly approved at the General Meeting of the Company held on the 15th and 16th day of May, 2013 at its Head Office at No. 23 Aka Idak Eyop Street Uyo, are on top of the situation as regard the appearance of counsels for hearing fixed for 19th of October, 2015 in the Supreme Court of Nigeria. God is not wicked.

(4.0) Financial Assistance and Conclusion

(4.1) Owing to the poor financial position of Comandclem Nigeria Limited after the death of the King, members of the public, patentees, and even volunteers are pleaded to in terms of financial assistance to raise the sum of N1.4million being appearance fees for CCNL`s legal team for hearing fixed for on the 19th day of October, 2015 in the Supreme Court of Nigeria.
