(1.0) Introduction

(1.1) The hearing of Status Quo Application instituted by Comandclem Nigeria Limited And Two (2) Of Its Directors against Queen Akon Uwemedimo, Prince Reginould Uwemedimo, Pastor Monday Obo Akpan, and four (4) others has been adjourned to the 15th day of February, 2016 due to the ill health of Barrister Linus Mbay ESQ from Professor Tony Ukam Chamber.

Note:
Late King Professor CJA Uwemedimo had debriefed Professor Tony Ukam on 20th of October, 2011.  Letter of debriefing is hereby attached.


(1.2) Barrister Linus Mbay ESQ is a lawyer representing Queen Akon Uwemedimo, Prince Reginould Uwemedimo and Pastor Monday Obo Akpan, while Barrister Ifeanyi Idika ESQ is the Counsel appearing for Comandclem Nigeria Limited and two (2) of its Directors in Suit No. FHC/UY/CS/1111/2015 before Honourble Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division.


(1.3) On the 13th day of January, 2016, when the Status Quo Application was for hearing before Honourable Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division, the Court was notified of An Adjournment Application purportedly signed by  Barrister Linus Mbey ESQ and I quote parts of the application verbatim.

“Incidentally, I would not be appearing before his lordship on the ground of ill health.

Kindly inform his lordship of the above and I humbly request that the matters be adjourned to any of the following dates to enable me appear;15th 29th, February or 7th 10th 14th and 16 march, 2016. "

(2.0) What Is Status Quo Application?

(2.1) On the 2nd day Of June, 2015, in the Supreme Court of Nigeria before Honourable Justice Walter Nkanu Onnoghen (JSC) in an Appeal against Mobil Producing Nigeria Unlimited, one Professor Bankole Sodipo appeared before the Justices of the Supreme Court of Nigeria claiming to have being employed by The Self Acclaimed Only One Surviving Director in CCNL, Queen Akon Uwemedimo, and The Self Acclaimed Only One Surviving Secretary in CCNL, Prince Reginould Uwemedimo; contrary to the set of lawyers (Aiku Babatunde (SAN), Barrister Jesse Daniels ESQ, Barrister Kunle Faokunla ESQ) handling the appeal during the life-time of Late King CJA Uwemedimo.

(2.2) From the body language of this charge and bail lawyer, Professor Bankole Sodipo, as exhibited on the 19th day of October, 2015, before the Honourable Justices of the Supreme court of Nigeria, it was obvious that Professor Bankole Sodipo, might have concluded an underground plan with some staff of Mobil Oil to kill CCNL Appeal in order to receive small money behind, and destroy the investments of thousands of innocent Nigerians.

(2.3) In realization of the fact that Professor Bankole Sodipo who was neither briefed by Late King CJA Uwemedimo nor employed by CCNL`s Board of Directors suddenly hijacked CCNL`s Appeal in the Supreme Court of Nigeria from the set of lawyers dully employed by the Late Chairman of the company; Two (2) Directors In CCNL instituted a Status Quo Application in the Federal High Court, Uyo Judicial Division praying for the following interlocutory injections among others.

-AN ORDER of interlocutory injunction restraining Queen Akon Uwemedimo, and Prince Reginould Uwemedimo by themselves or acting in concert with any person from taking any step to disengage or disclaim any staff, personnel or officer of Comandclem Nigeria Limited, or take any action affecting the affairs and Management of Comandclem Nigeria Limited, without the authorization of the Management Board of Comandclem Nigeria Limited, pending the determination of this suit.

-AN ORDER of interlocutory injunction restraining Queen Akon Uwemedimo, and Prince Reginould Uwemedimo from unilaterally debriefing, disengaging or substituting the set of solicitors duly briefed, appointed and engaged by the late Chairman of Comandclem Nigeria Limited, King C.J.A Uwemedimo in his lifetime, comprising of: Tunde Aiku S.A.N, Rev. Jesse Daniel Onuigbo, Esq and Kunle Faokunla, Esq. to handle the Company’s brief at the Supreme Court; and from briefing any other solicitor to handle same, pending the determination of the substantive suit.

(3.0) Barrister Linus Mbey ESQ Hospitalized Over Supreme Court Ruling Which Made Him Lawyer Of CCNL

(3.1)On the 12th day of November, 2015, when the Status Quo Application came-up before Honourable Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division, Barrister Linus Mbay ESQ misinformed the court that The Honourable Justices of the Supreme Court had made him the Counsel to represent Comandclem Nigeria Limited when he said and I quote him verbatim.

“On the 19/10/15, when we were in the Supreme Court for a matter concerning the 5th respondent (Comandclem Nigeria Limited) in suit no sc/69/2011, we appeared for the 5th respondent (Comandclem Nigeria Limited).”

(3.3) Haven realized that Barrister Linus Mbay ESQ had misinformed the court to score unmerited points; Barrister Ifeanyi Idika ESQ properly informed the court as follows.

“The person who appeared for the company as permitted by the Supreme Court for the matter to go on that day was one Prof. G. D. Bankole.

The suit SC/69/2011 has no connection with this suit. The Supreme Court did not order the counsel Mbeng to represent the 5th respondent (Comandclem Nigeria Limited) in this case.”

(3.4) In full realization of the fact that no court in Nigeria has jurisdiction to select a lawyer for a party, Honourable Justice Ijeoma L. Ojukwu requested Barrister Linus Mbay ESQ to produce the ruling of the Supreme Court of Nigeria where The Honourable Justices had selected him the lawyer to represent Comandclem Nigeria when the court said and I quote verbatim.

“The court hereby orders Linus  Mbeng of learned counsel who assents that the Supreme Court decided that he represent the 5th respondent (Comandclem Nigeria Limited) to produce the decision and proceedings of the Supreme Court on this matter (certified copies please).”

(3.5) On the 13th day of January, 2016, when the hearing of the Status Quo Application came-up before Honourable Justice Ijeoma L. Ojukwu, Barrister Linus Mbay ESQ failed to exhibit ruling of the Supreme court which made him the lawyer of Comandclem Nigeria Limited but only requested for an adjournment in a letter adduced by Pastor Monday Obo Akpan to the court stating that he could not appear in court due to ill health.

(3.6) To respect the fair hearing of all the parties in the case, Honourable Justice Ijeoma L. Ojukwu, adjourned the suit to the 15th day of February, 2016, to enable Barrister Linus Mbay ESQ to exhibit the ruling of the Supreme court which made him the lawyer of Comandclem Nigeria Limited.

(4.0) Conclusion

(4.1) On the 19th day of October, 2015, Honourable Justice Fabiyi (JSC) adjourned the hearing of the Restoration Application to the 23rd day of February, 2016.

(4.2)There are unconfirmed rumour of Secret Cash Negotiation (SCN) in the air among Some Staff Of Mobil Oil And Professor Bankole Sodipo, Pastor Monday Obo Akpan & Prince Reginould Uwemedimo to destroy the appeal of Comandclem Nigeria Limited on the 23rd day of February, 2016 for a Secret Cash Settlement (SCS) without the knowledge of any patentee.

(4.3)In view of the fact that Professor Bankole Sodipo might have compromised, deducible from his body language, the Board of Directors in Comandclem Nigeria Limited held a meeting on the 17th of December, 2015, to resolve and review the teams of lawyers to represent Comandclem Nigeria Limited on the 23rd of February, 2016 in the Supreme Court so that Professor Bankole Sodipo will not destroy the investments of innocent patentees for the sole benefit of Mobil Producing Nigeria Unlimited.

(4.4) Board of Directors in Comandclem Nigeria Limited is on top of the situation as discussions are on-going for one big legal representation on the 23rd of February, 2016, in the Supreme Court of Nigeria.

(4.5)The projects of Comandclem Nigeria Limited are projects of Almighty God. The projects of God can never be destroyed by anybody.

(4.6) Almighty God started the projects of Comandclem Nigeria Limited, and He never requires any human knowledge and intervention to perfect it.

(4.7) We shall not labour in vain.
