“The second point that is pertinent is that the first appellant in the main appeal that was dismissed who is the first cross respondent in the cross appeal which my learned friend wishes to argue before your lordship this afternoon died on 18th of July, this year.

My lords, in that respect, it will be expedient in these circumstances to amend all the court`s processes before your lordship to reflect the substitution of the deceased, first appellant in the main appeal and the first cross respondent in the cross appeal”

What are the legal interpretations of the ruling of Honourable Justice Galadima (JSC) on the substitution of name when the court said and I quote.

-“Cross appeal is a separate appeal on its own, it stands on its own. Cross appellant has the right to choose who to pursue in his cross appeal.”
- In summary, the application is incompetent and it is accordingly dismissed.

(2.4.5)Principle Of Privities Of Contract: Mobil Cannot Sue Reginuould Uwemedimo In Its Cross Appeal.

Applying the principle of privities of contract, Mobil never had any contract with Reginould Uwemedimo but CJA Uwemedimo in 1980.
Reginould Uwemedimo cannot sue Mobil and Mobil cannot sue Reginould Uwemedimo.

(2.4.6)How Mobil Admitted Paragraph 13 Of CCNL`s Amended Statement Of Claim Which Was Denied In Paragraph 13 Of The Amended Statement Of Defense To Forfeit Application For Substitution Of Name.

How Mobil confused Professor Bankole Sodipo easily by approbating and reprobating concurrently on the 1980 contract between King Professor CJA Uwemedimo and Mr. F. Hawkins, Mr. Tom Lafferty and Mr. G. Walker to dismiss the substitution of the king`s names.

Please, keep in view.

(3.0)Conclusion
(3.1) The Board of Directors will do everything legally to protect the investments of innocent patentees in the face of resistance from Queen Akon Uwemedimo, Prince Reginould Uwemedimo , Pastor Monday Obo Akpan and Professor Bankole Sodipo.

(3.2) Once more, we feel your pains, difficulties, and inconveniencies being encountered in recent times due to the unsolicited interference of Adiamiko Family with the administration of Comandclem Nigeria Limited.
