(1.0) Introduction

(1.1) The case (FHC/CS/UY/1111/2015) instituted by Comandclem Nigeria Limited and two (2) of its Directors challenging the unilateral power of Prince   Reginould Uwemedimo, and Queen Akon Uwemedimo to debrief the competent Senior Advocate Of Nigeria, Babatunde Aiku (SAN, and engage the legal services of the incompetent lawyer from Unilag, Professor Bankole Sodipo, could not hold on the 4th day of April, 2016, before Honourble Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division owing to the Federal High Court`s Long Easter Holiday Vacation which started on the 25th of March, 2016 and ended on the 4th of April, 2016.

(1.2) In full realization of the fact that Prince Reginould Uwemedimo, and Queen Akon Uwemedimo who single-handedly employed the service of this Professor Of Panadol Extra from Unilag, Professor Bankole Sodipo, might have compromised the royalties of Nigerians with Mobil Producing Nigeria Unlimited as demonstrated in the last three (3) consecutive hearing failures in the Supreme Court of Nigeria, Comandclem Nigeria Limited and two (2) of its Directors sued Queen Akon Uwemedimo, Prince Reginould Uwemedimo, Pastor Monday Obo Akpan and four (4) others for an order of the court to maintain the status quo so as to protect the investments of innocent patentees.

- The letter of debriefing of Babatunde Aiku signed by the only surviving director, Akon Uwemedimo, is hereby attached.

- The letter of engagement of Professor Sodipo signed by only one surviving secretary, Reginoiud Uwemedimo, is attached.


(2.0) The Chronological Order Of Hearing Status Quo Application

(2.1)On The 12th Day Of November, 2015.

(A) Hearing:

-The Status Quo Case came-up before Honourable Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division, then, Barrister Linus Mbay ESQ misinformed the court that The Honourable Justices of the Supreme Court had made him the Counsel to represent Comandclem Nigeria Limited in the case.

(B) Court Pronouncement:

- Honourable Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division, ordered Barrister Linus Mbay ESQ to produce the certified true copy of the Supreme Court ruling which made him CCNL Counsel and subsequently adjourned the case to the 13th day of January, 2015.

(2.2) On the 13th day of January, 2016.

(A) Hearing:

-The hearing of the Status Quo Suit came-up before Honourable Justice Ijeoma L. Ojukwu, but Barrister Linus Mbay ESQ failed to exhibit ruling of the Supreme Court which made him the lawyer of Comandclem Nigeria Limited.
- Barrister Linus Mbay ESQ only requested for an adjournment in a letter adduced by Pastor Monday Obo Akpan to the court stating that he could not appear in court due to ill health.

(B) Court Pronouncement:

-In view of the above, Honourable Justice Ijeoma L. Ojukwu, adjourned the suit to the 15th day of February, 2016, to enable Barrister Linus Mbay ESQ to exhibit the ruling of the Supreme Court which made him the lawyer of Comandclem Nigeria Limited.

(2.3) On The 15th Day Of February, 2016.

(A) Hearing:

-Barrister Linus Mbay ESQ haven being discharged from the hospital, announced his appearance for Queen Akon Uwemedimo, Prince Reginould Uwemedimo and Pastor Monday Obo Akpan but failed woefully to exhibit the Supreme Court of Nigeria Rulings held on the 19th of October, 2015 which made him CCNL Lawyer.

(B) Court Pronouncement:
In view of the above, among other things, the court adjourned the case to April 4, 2016 for hearing.

(2.4) On 4th Of April, 2016

(A) Hearing:
The hearing of the status quo case could not hold due to the long Easter Holiday Vacation which started on the 25th of March, 2016 and ended on the 4th of April, 2016.

The pieces of online information at my disposal as exhibited on the website of the federal high court are stated below.

-Pursuant to Order 47 Rule 4 (1) b of the Rules of this Court, the Easter Vacation shall commence on Friday 25th March 2016.
- Court sitting will resume on Tuesday 5th April 2016.
- Hon Justice U. A. Musale has been appointed as Vacation Judge for the period.

(B) Court Pronouncement:
-In view of the above, the case has been adjourned to 16th of May, 2016 for hearing.

(3.0) Reasons Why Patentees Should Support Comandclem Nigeria Limited In Suit (FHC/CS/UY/1111/2015)

(3.1) The plausible needs to support Comandclem Nigeria Limited in the Status Quo Case have been emphasized by Patentees in Lagos State in a meeting held recently in view of its importance to the going concern of the company, and speedy conclusion of the case against Mobil Producing Nigeria Unlimited ongoing in the Supreme Court of Nigeria.

(3.2) One of the Elders of Patentees (who prefers non-disclosure of his identity) in Lagos State in a meeting held recently said;

-Late King Professor CJA Uwemedimo had good plans for Nigerians most especially Patentees.

-His legacies must be maintained to protect the investments of innocent patentees.

-When Queen Akon Uwemedimo and Prince Reginould Uwemedimo deviated from the legacies of the King, what happened to them?

-They failed in three (3) consecutive times in the Supreme Court of Nigeria and caused unnecessary daley in the final determination of the case.

-We have adopted all means to talk to them, but all aborted.

-The status Quo case in the Federal High Court Uyo, will correct all the errors made by Queen Akon Uwemedimo & Prince Reginould Uwemedimo and empowered the appointed board of directors to follow the legacies of the King so as to protect the investments of Innocent Patentees.

-I enjoined Patentees across Nigerian to support the appointed board members financially and in prayers to protect their investments.

- With God, everything is possible.

(4.0)   Objectives Of The Status Quo Application

(4.1) In the Status Quo Application, Comandclem Nigeria Limited and two (2) of its Directors are praying the Federal High Court, Uyo Judicial Division for the following orders among others.

(A) An order setting aside all the steps or actions purportedly taken by Queen Akon Uwemedimo and Prince Reginould Uwemedimo without the authorization of Comandclem Nigeria Limited or its Management Board, or acting in the capacity of Company Secretary, as null and void ab initio, and of no effect.

(B) An order of perpetual injunction restraining Pastor Monday Obo Akpan whether by himself, his agents or privies, or any person or group of persons directly or indirectly from further interfering with the due administration, management and affairs of Comandclem Nigeria Limited

(C) A declaration that the purported resolution or mandate contained in the letter dated 24th September, 2014 issued  by Adiamiko Royal Family to Pastor Monday Obo Akpan to take over the management of Comandclem Nigeria Limited is illegal, null and void and of no effect whatsoever. 

(5.0)   Conclusion

(5.1) The Long Easter Holiday Vacation denied Honourble Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division, jurisdiction to continue the hearing of the Status Quo Application On 4th of April, 2016 as demonstrated by Honourable Justice Obaseki, (J.S.C) in the case involving Itaye & Ors Versus Ekaidere & Ors (1978) LPELR-1558(SC), and I quote verbatim;

"We are therefore in no doubt that it is the law that the High Court will not normally sit or open during vacation to hear or continue the hearing of cases.

While the annual court vacation cannot be described as public holiday, its legal effect on court proceedings is similar”

(5.2) In full realization of the fact that all the parties have filed all the necessary litigation papers/correspondences, the court adjourned the Status Quo Application to the 16th day of May, 2016 for the continuation of the hearing.

(5.3) The Board of Directors will do everything legally to protect the investments of innocent patentees in the face of resistance from Queen Akon Uwemedimo, Prince Reginould Uwemedimo , Pastor Monday Obo Akpan and Professor Bankole Sodipo.

(5.4) Once more, we feel your pains, difficulties, and inconveniencies being encountered in recent times due to the unsolicited interference of Adiamiko Family with the administration of Comandclem Nigeria Limited.

(5.5) We appreciate your understanding in this regard as we are looking forward to the 16th day of May, 2016, for the hearing of the status quo application before Honourable Justice Ijeoma L. Ojukwu of the Federal High Court, Uyo Judicial Division.
