(4.0)Non Appearance of Babatunde Aiku (SAN) & Kunle Faokunla Esq  For CCNL In Supreme Court of Nigeria.

(5.0) What Are The Ways Forward?

(1.0) Introduction.

(1.1) Market women, civil servants, business men, artisans, students, even unemployed youths who had invested in the patented invention of Comandclem Nigeria Limited supported Late King CJA Uwemedimo financially to defeat Mobil Producing Nigeria Unlimited over patent right infringement in court, and most importantly to set Nigerians free from economic dependency, exploitation of the black race, and maltreatments of the First Nigerian Black Inventor.

(1.2) Innocent Patentees have exercised enough patience awaiting the finalization of the case and the subsequent payment of their royalties haven invested in the intellectual property of Comandclem Nigeria Limited for years without any return on their investments.

(1.3) Before the death of King Professor CJA Uwemedimo on 18th of July, 2014, all the court papers necessary for the Judges of the  Supreme Court of Nigeria to finalize the appeal had been made available by both Comandclem Nigeria Limited and Mobil Producing Nigeria Unlimited except the notice of withdrawal filed by Pastor Monday Obo Akpan (Ex-General Manager).

(1.4) Immediately after the death of the Chief Executive Officer of Comandclem Nigeria Limited, King Professor CJA Uwemedimo , unexpected internal crises erupted through a petition written to the Nigerian Police Force at Zone 6, Police Headquarters, Calabar by Prince Reginould Uwemedimo against Rev. Barr Jesse Daniels Onuigbo and Prince Ajamu Sunday Adedayo under the instructions of Queen Akon Uwemedimo and Pastor Monday Obo Akpan (Ex-General Manager).

(2.0) Petition Written By Prince Reginould Uwemedimo Against Rev. Barr Jesse Daniels Onuigbo And Prince Ajamu Sunday Adedayo.

(2.1) Part of the petition written in the personal hand-writing of Prince Reginould Uwemedimo in the name of Comandclem Nigerian Limited deposited with the Nigerian Police Force at Zone 6, Police Headquarters, Calabar on 20th of February, 2015, where he alleged that Rev. Barr Jesse Daniels Onuigbo of impersonating the position of the Secretary of CCNL is hereby stated below;

“I was shock that he mension that the board of director of the company shall have a special meeting on the 23th of febuary at the company` head quarter at No. 23 Aka Idak Eyop street, uyo Akwa Ibom state by 2:00PM.

So I travel back to my mothe Queen Akon Clement Uwemedimo who is also the director of Comandclem Nigeria limited to confirm if she have given anybody an authority to hold any meeting in the name of the company`s board of directors BOD but she answer “NO” so I realized that Jesse Daniel (also) omuigbo (have) is trying to impersonate.”

(2.2) Furthermore, parts of the petition written by Prince Reginould Uwemedimo in the name of Comandclem Nigerian Limited deposited with the Nigerian Police Force at Zone 6, Police Headquarters, Calabar on  20th of February, 2015 where Prince Reginould Uwemedimo alleged Prince Ajamu Sunday Adedayo  of selling company`s cars and bus is hereby stated below.

“Ajamu Sunday Adedayo is presently going about selling company`s cars/bus changing manager at will (also) and other fraudulent atrocities that shall be mension in the process of prosecution.

I pleade that this office shall use thie wede to arrest and (ihour) thoroughly investigate these mension in this matter. Thanks. “

(3.0) Reasons Why Rev. Barr Jesse Daniels Onuigbo And Prince Ajamu Sunday Adedayo Sued Prince Reginould Uwemedimo  And Comandclem Nigeria Limited.

(3.1) On the 23rd day of February, 2015, while the Board of Directors` meeting was about to commence,  Prince   Reginould Uwemedimo arrested Barrister Jesse Daniels Onuigbo but Prince Ajamu Sunday Adedayo narrowly escaped Police arrest due to his late arrival at the venue of the meeting.

(3.2) In paragraph 39 of the Affidavit In Support Of Motion Ex-Parte For Interim Orders, Barrister Jesse Daniels Onuigbo said that,

“That on the 23rd day of February 2015, at about 1:00pm, I arrived at the venue of the Board meeting, and other members of the Board from different parts of the country have started arriving, including Prince Reginould   Uwemedimo when suddenly, Pastor Monday Obo Akpan (the dismissed former General Manager of the Company) and Innocent Ita led a team of Policemen including ASP Charles Abassi, from the Zone 6 Police Headquarters Calabar, to storm the venue of the meeting and arrested me.”

(3.3) Barrister Jesse Daniels Onuigbo never realized that Prince Reginould Uwemedimo was the master planner of his arrest until when Prince Reginould Uwemedimo joined the team of policemen to take Barrister Jesse Daniels Onuigbo to the C: Division of the Nigeria Police, Uyo.

(3.4) In Paragraph 41 of the Affidavit In Support Of Motion Ex-Parte For Interim Orders, Barrister Jesse Daniels Onuigbo said and I quote him verbatim.

“That I asked them why they were arresting me but they said I will know when we get to Calabar. It was at this point that Prince Reginould Uwemedimo who had pretended to have come for the Board Meeting, joined the team of Policemen to take me, first of all, to the C: Division of the Nigeria Police, Uyo.”

(3.5) Sequel to the illegal arrest and detention of Barrister Jesse Daniels Onuigbo, and threat to arrest and detain Prince Ajamu Sunday over the aforesaid petition written by Prince Reginould Uwemedimo under the instructions of Queen Akon Uwemedimo and Pastor Monday Obo Akpan (Ex-General Manager) , their lawyer, Barrister Onyekachi. M. Ede Esq, from Providence Chambers, 13 Nnobi Road, Nnewi, Anambra State, instituted a legal suit against Prince Reginould Uwemedimo and Comandclem Nigeria Limited under whose legal name the aforesaid petition was written before Honourble Justice Ijeoma L. Ojukwu (FHC/UY/CS/61/15) of the Federal High Court, Uyo.

(3.6) Prince Reginould Uwemedimo’s  calculated devilish aim of arresting and detaining   Barrister Jesse Daniels Onuigbo, and threat to arrest and detain Prince Ajamu Sunday is to intimidate and harass them so as to forcefully push them out of the administration of Comandclem Nigeria Limited for his own greediness purpose.

(3.7) This calculated devilish aim of Prince Reginould Uwemedimo became obvious in a respondents’ written address he filed in the Federal High Court Uyo on 27th day of May, 2015, where he exhibited that one Michael Sunday actually sold the company bus to one Mrs. Serah Alagbe contrary to the petition Prince Reginould Uwemedimo wrote to the Nigerian Police Force at Zone 6, Police Headquarters, Calabar against Prince Ajamu Sunday Adedayo.

(3.8) Prince Reginould Uwemedimo petitioned the Nigerian Police Force at Zone 6, Police Headquarters, Calabar that Prince Ajamu Sunday Adedayo sold CCNL`s buses and cars; the same Prince Reginould Uwemedimo could not exhibit a single evidence where Prince Ajamu Sunday Adedayo had sold CCNL`s buses and cars but exhibited evidences where one Michael Sunday actually sold the company bus to one Mrs. Serah Alagbe contrary to the petition Prince Reginould Uwemedimo . What a contradiction!

Note:
(1)Affidavit For Change Of Ownership

(2) Change Of Ownership Certificate

Both filed by Prince Reginould Uwemedimo in the court are hereby attached.

(4.0) Non Appearance of Babatunde Aiku (SAN) & Kunle Faokunla Esq  For CCNL In Supreme Court of Nigeria.

(4.1) In view of the fact that Babatunde Aiku (SAN) & Kunle Faokunla Esq communicated their decisions not to appear for CCNL very late,  Barrister Jesse Daniels Esq was left with no option than to take the bull by the horn and appear for CCNL on the 19th of October, 2015.

(4.2) On the 19th day of October, 2015 when the hearing of Restoration Application was before Honourble Justice Fabiyi (JSC), both Barrister Jesse Daniels Esq and Professor Bankole Sodipo announced their appearances for Comandclem Nigeria Limited.

(4.3) In the course of arguments between Barrister Jesse Daniels Esq and Professor Bankole Sodipo as to determine the proper lawyer to represent Comandclem Nigeria Limited, Honourable Justice Ariwoola (JSC) said as follows

“Reverend, your case where you sue the company at the Federal High Court is still there.”

Barrister Jesse Daniels Esq Replied As Follows
Yes my lord, it is still subsisting.

Honourable Justice Ariwoola (JSC) continued and said.

-What do you want to do with that?  Only you know.

-Why can you now come to this court to represent the same company you have an action against?

-Is that ethical enough? No No No ……………………

-Does this profession allow for that?

-Can you now represent the company you had sued? and the matter is yet to be resolved? And you want to be the counsel to the same company?

-Let us make progress that is what the PJ(Presiding Judge) said.

-We are going to make progress with this. If you are dealing with your case in the Federal High Court, you can go and deal with it, please deal with it.

(5.0) What Are The Ways Forward?
