(1.0) Introduction

(1.1) The teaming Patentees who had invested in the patented invention of Late King Professor CJA Uwemedimo, RP:13522, have advised Professor Bankole Sodipo to step-aside from appearing for Comandclem Nigeria Limited in an appeal against Mobil Producing Nigeria Unlimited fixed for 23th day Of February, 2016,  in the Supreme Court Of Nigeria.

(1.2) The agitations calling for the stepping-aside of Professor Bankole Sodipo among the CCNL`s Legal Counsels have been necessitated by his woeful performances and deliberate attempt to destroy the investments of Nigerians for the sole benefit of a foreign multi-national oil company, Mobil Producing Nigeria Unlimited.

(1.3) In his determination to destroy the Appeal of Late King CJA Uwemedimo & the investments of Nigerians in CCNL, Professor Bankole Sodipo admitted series of allegations denied by CCNL, and turned the entire Appeal upside-down favourable to  a foreign multi-national oil company, Mobil Producing Nigeria Unlimited.


(2.0) Restoration Affidavit Filed By Professor Bankole Sodipo

(2.1) In the strong determination of Professor Bankole Sodipo to destroy the appeal of CCNL became apparent in the affidavit he filed in the Supreme Court of Nigeria but deposed to by one Augustine Egbunonwo, suspected to be his staff.

(2.2) Paragraph 5 of the contradictory affidavit is hereby quoted below verbatim.


“I, AUGUSTINE EGBUNONWO, Male, Christian, Nigeria Citizen of 27/29, King George V. Road Onikan, Lagos, do hereby make oath and state as follows;

(5) That the Appellants (King Uwemedimo & CCNL) at no time intended to withdraw this appeal and the said Notice of withdrawal was purportedly filed in error.

(3.0) Denial Of Professor Tony Ukam On Notice Of Withdrawal

(3.1) On the 5th of May, 2014, Honourable Justice Walter Nkanu Onnoghen (JSC) dismissed the Appeal of CCNL on the ground that Professor Tony Ukam (Former Counsel of CCNL) had filed a Notice Of Withdrawal as far back as 24th of March, 2011 when he said and I quote.

“There is nothing to be adjourned as the appeal withdrawn has ceased to exist. In the circumstance, appeal SC./69/2011 withdrawn is hereby dismissed.”

(3.2) It is on record that on 12th of May, 2014, King Professor Emeritus CJA Uwemedimo officially wrote a letter to Professor Tony Ukam questioning him on the justifications to withdraw his case without his instructions to that effect. Below is an extract of the letter.

“My shock and surprise stemmed from the fact that I never instructed you to apply to withdraw the aforesaid appeal; neither did you notify me of your having done the same till date.”

(3.3) Professor Tony Ukam completely denied filling any notice of withdrawal in his respond dated 16th of May, 2014 when he said and I quote as extract of the letter.

Permit me to say that;
(c) Apart from the processes you mandated me to file in 2011 as a fall-out meeting with former President Obasanjo, I’ve never filed anything since 2012 when you decided to abandone me for lawyers who knew not the sweat/history of Comandclem and the innocent patentees”

(4.0) Contradictions of Professor Bankole Sodipo

(4.1) Haven being employed by the self-acclaimed “Only Surviving Director”, Queen Akon Uwemedimo, and “Only Surviving Secretary”, Prince Reginould Uwemedimo to destroy the investments of Nigerians, Professor Bankole Sodipo adduced evidences contradictory to the claims of Late King Professor CJA Uwemedimo, and Professor Tony Ukam before the Supreme Court of Nigeria as deposed to in the restoration affidavit stated below.

“I, AUGUSTINE EGBUNONWO, Male, Christian, Nigeria Citizen of 27/29, King George V. Road Onikan, Lagos, do hereby make oath and state as follows;

(5) That the Appellants (King Uwemedimo & CCNL) at no time intended to withdraw this appeal and the said Notice of withdrawal was purportedly filed in error.

(5.0) Unwritten Rulings Of The Supreme Court of Nigeria.

(5.1) On the 19th of October, 2015, when the restoration motion was before the Honourable Justices of the Supreme Court of Nigeria, Professor Bankole Sodipo turned the Appeal of CCNL upside-down by admitting the allegations of Notice Of Withdrawal which Professor Tony Ukam denied in a letter to the king; even claimed that Pastor Monday Obo Akpan (Ex-General Manager in CCNL) actually filed the aforesaid Notice Of Withdrawal in error in the Registry of the Supreme Court but failed to pay court bailiff to serve Mobil Producing Nigeria Unlimited.

(5.2) In full realization that of the fact that Professor Bankole Sodipo failed woefully to convince the court on the justifiable reasons to restore the already dismissed appeal filed by Comandclem Nigeria Limited, Honourable Justice Kekere-Ekun (JSC) said to Professor Bankole Sodipo and I quote her verbatim.

“- Learned counsel listen, whichever Counsel (Tony Ukam) is handling the matter has the control and conduct of the matter.

- Whatever negotiation you might have had, whatever advice you might have been given, that counsel (Tony Ukam) is the one who is in charge of the case.

- And if he (Tony Ukam) filed a notice of withdrawal, he (Tony Ukam) knows the implication in law of filing a notice of withdrawal.

- If you took that decision, you cannot say it was taken in error.

-Whatever discussion he (Tony Ukam) might have had with whomever, he (Tony Ukam) is a legal practitioner, he (Tony Ukam) knows the law.

- Base on whatever conversation, he (Tony Ukam) decided to file a notice of withdrawal and as a counsel, he (Tony Ukam) knows the implications of filing a notice of withdrawal, he (Tony Ukam)  cannot say he filed it in error.”

Professor Bankole Sodipo Interrupted And Said As Follows.

-No no no no my lord.

- What we are saying is that for the notice of withdrawal to be effective under order 8 rule 6 (1).

-It must have been filed and served. Service is important, that is what the rule says.

-The cases where this issue has been contented, my lard, there is no where an issue of service was raised, they were talking of consent; we are not talking of consent my lord; we are talking of service.

-They were not aware that anything was filed.

-We must not wait for the respondent (Mobil oil) or for the applicants (CCNL) who filed to withdraw.

-You (CCNL) have submitted to the Court`s jurisdiction, that I had filed a process to withdraw my appeal, good-luck to you the court.

-Deal with it, if you like.

-You (CCNL) don’t need to show-up, mush more the respondent (Mobil Oil).

(6.0) Who Represents CCNL On 23rd Of February, 2016, In The Supreme Court Of Nigeria?

(6.1) On the 23rd day of February, 2016, The Honourable Justices of the Supreme Court of Nigeria shall entertain the Restoration Application filed by the Self-Acclaimed And The Highly Rated Professor Of Patent Law, Professor Bankole Sodipo, which can never, never and even never resurrect the dismissed appeal of late King Professor CJA Uwemedimo and Comandclem Nigeria Limited.

(6.2) On 19th of October, 2015, the Self-Acclaimed And The Highly Rated Professor Of Patent Law, Professor Bankole Sodipo made an oral application to withdraw the Restoration Application filed by Comandclem Nigeria Limited under the supervision and instruction of Late King Professor CJA Uwemedimo.

(6.3)This Self-Acclaimed And The Highly Rated Professor Of Patent Law, Professor Bankole Sodipo, haven orally withdrawn the Restoration Application filed by Comandclem Nigeria Limited under the supervision and instruction of Late King Professor CJA Uwemedimo, Honourable Justice Fabiyi (JSC) was left with no option than to strike-out the aforesaid Restoration Application.

(6.4)Without any prolonged argument, the legacies, suffering, sweats and work of Late King CJA Uwemedimo have been destroyed by this Self-Acclaimed And The Highly Rated Professor Of Patent Law, Professor Bankole Sodipo.

(6.5)There are unconfirmed rumour of Secret Cash Negotiation (SCN) in the air among Some Staff Of Mobil Oil And Professor Bankole Sodipo, Pastor Monday Obo Akpan & Prince Reginould Uwemedimo to destroy the appeal of Comandclem Nigeria Limited in the next hearing date for a Secret Cash Settlement (SCS) among Professor Bankole Sodipo, Pastor Monday Obo Akpan & Prince Reginould Uwemedimo without the knowledge of any patentee.

(6.6)In view of the fact that Professor Bankole Sodipo might have compromised, deducible from his body language, teaming patentees, who had invested their last cards on the patented invention of Late King Professor CJA Uwemedimo, RP:13522, have advised Professor Bankole Sodipo to step-aside from appearing for Comandclem Nigeria Limited in an appeal against Mobil Producing Nigeria Unlimited fixed for 23th day Of February, 2016,  in the Supreme Court Of Nigeria.

(7.0) Position Of Anti-Corrosive Vanguard On The Appearance Of Professor Bankole Sodipo

(7.1) As Patentees await the Hearing Of Restoration Application against Mobil Producing Nigeria Unlimited ongoing in the Supreme Court of Nigeria fixed for 23rd of February, 2016, despite the pendency of the Status Quo Suit (FHC/UY/CS/1111/2015) in the Federal High Court, Uyo, contesting the appearance of Professor Bankole Sodipo for CCNL in the Supreme Court of Nigeria, an average provider of fund in CCNL may express fear over their investments.

(7.2) At this juncture, Anti-corrosive Vanguard considers it paramount to state it emphatically that the investments of innocent patentees shall be protected by CCNL irrespective of all the Anti-Comandclem and Enemies of Nigerians.

(7.3) Being a pendency suit against Professor Bankole Sodipo with respect to his appearance for CCNL in the Supreme Court of Nigeria, Professor Bankole Sodipo is under obligation to refrain from appearing for CCNL despite the fact that the interlocutory injunction has not been granted by the Federal High Court, Uyo, Judicial Division.

(7.4) The above principle of law was demonstrated by Honourable Justice EKO, JCA in the case of ABBI v. PRINCEWILL & ORS.(2011) LPELR-3952(CA) when the court said and I quote verbatim below.

"Let me restate the principle for restorative injunction further, where proceedings are pending before a court wherein injunctive reliefs are sought, the party against whom those injunctive reliefs are sought is under obligation to refrain from doing that which is sought to be restrained, even when no temporary order of injunction may have been granted. See EZEGBU v. F.A. T.B. (1991) 1 NWLR (pt. 220) 669 at 725;

(7.5) As the event unfold in the Supreme Court of Nigeria with respect to the Restoration of CCNL Appeal fixed for hearing on the 23rd day of February, 2016, Anti-Corrosive Vanguard shall publish the blow by blow account of the proceedings .
